Abstract
IT – Questa breve riflessione mira ad evidenziare se l’addetto Upp sia un mero funzionario di cancelleria penale ovvero svolga funzioni giurisdizionali insieme al giudice affidatario, tenendo conto dell’ordine di servizio che il dirigente del tribunale assegna, in base anche alle risorse umane disponibili. Se le mansioni principali sono quelle di motivazione delle sentenze dei magistrati, che senso ha assegnare funzioni di cancelleria per personale che dovrebbe essere assunto invece con un concorso ad hoc? In molti tribunali c’è una discrepanza tra Aupp chiusi nelle stanze del giudice a motivare e altri destinati a funzioni di cancelleria che subiscono un trattamento lavorativo iniquo, nonostante lo stesso trattamento economico tabellare. La ricerca mira a rispondere a tali domande attraverso delle riflessioni derivanti da studi all’interno dei tribunali ordinari o delle corti d’appello di chi giudica e di chi motiva.

ENG – This brief reflection aims to highlight whether the new law clerk of the Italian trial office is a mere criminal registry officer or performs judicial functions together with the Court entrusted, taking into account the order of service that the head of the tribunal assigns on the basis of human resources available. If the main tasks are to write the grounds of judgments, what is the point of assigning registry functions to staff who should instead be recruited by an ad hoc competition? In many courts there is a discrepancy between the clerks of the Trial Offices closed in the rooms of the judge to write the grounds of judgments and other law clerks destined for clerical duties that suffer an unfair working treatment despite the same economic treatment. The research aims to answer these questions through reflections derived from studies within the ordinary courts or the courts of appeal.
